“ARIA REAL ESTATE TOURISM CONSTRUCTION TRADE AND INDUSTRY LIMITED COMPANY (“Villas Planet Luxury”) wishes to send commercial electronic messages to me for the purpose of promoting new products and campaigns, among other activities, through the website www.villasplanetluxury.com. I consent to Villas Planet Luxury using my phone number, email, and address through electronic mail and mobile applications to contact me, and I approve the storage and use of the information I have shared with Villas Planet Luxury, as well as the recording and storage of the content of commercial electronic messages and other related records for presentation to the Ministry of Customs and Trade when necessary. This Commercial Electronic Message Consent is an integral part of the explanation and Privacy Policy regarding the protection of personal data at https://www.villasplanetluxury.com/kisisel-verilerin-korunmasi.

Parties and Purpose

This contract is made between the renter of the villa (hereinafter referred to as the ‘customer’) and the lessor of the villa (hereinafter referred to as ‘Villas Planet Luxury’) for the purpose of renting a villa for a specified period with predetermined start and end dates. Customers who make a reservation for any of our villas listed on our website through our website, by phone, or by email, and their companions are deemed to have accepted the following conditions in advance. Any behavior contrary to the following terms gives Villas Planet Luxury the right to unilaterally cancel the reservation, request the customer to vacate the villa, and retain the deposit and rental fee.

Reservation and Payment

Reservations can be made for our villas via the reservation form on our website, by phone, or by email. Once your reservation request reaches Villas Planet Luxury and the total amount is specified in GBP, EURO, USD, or TRY, you will receive an email or SMS or phone call confirming your reservation details, and the villa will be reserved in your name for deferred payment of the deposit for distant dates. Information on the required deposit amount and our bank account numbers will be provided to you via email, SMS, or phone call after the availability of the villa is confirmed. If the deposit cannot be received by wire transfer or EFT within 1 (one) business day, Villas Planet Luxury reserves the right to cancel the pre-booking without informing the customer and to accept another reservation for the villa. In order to finalize your villa reservation, a portion (not exceeding 40%) of the total rental fee of the villa, to be mutually determined, must be paid as a deposit, along with the remaining amount and any damages, breakage, loss, etc., deposit specified on the villa’s features page, in cash to Villas Planet Luxury on the entry day to the villa. Until the villa entry, it is emphasized to ensure its readiness by the time of your villa entry.

Prices

The villa rental prices listed on our website are daily rates. Deposits can be made to our bank accounts via wire transfer or EFT.

Cancellation Conditions and Refund Terms
Customer Cancelling the Reservation

Cancellation terms are included in the guest contract sent to you after the advance payment is deposited into our account.

For cancellations made up to 30 days before your villa entry date, your advance payment will be forfeited because a large portion of this payment has already been made as an advance payment to the homeowner.
The remaining payment must be made upon entry to the villa. If you wish to cancel your reservation between 30 and 15 days before your entry date, 50% of the remaining payment amount will be collected from the customer. If the reservation is canceled within 14 days of the entry date or if no entry is made, the entire remaining payment amount will be collected from the customer.

Cancellation by Villas Planet Luxury

In unforeseen circumstances at our villas (such as problems in the plumbing system, flooding, landslides, earthquakes, etc.), Villas Planet Luxury reserves the right to cancel your reservation. This situation will be communicated to the customer as soon as possible. In such cases, Villas Planet Luxury is obligated to refund all payments made to the guest. At the Guest’s request, Villas Planet Luxury will attempt to offer alternative villas of at least the same standard during the same dates. The guest can choose one of the alternative villas or cancel the reservation entirely to receive a full refund of the payment made.

If the customer fails to make the remaining payment on time, Villas Planet Luxury reserves the right to cancel the reservation, not refund the amount already paid, and accept another reservation for this villa.

Reservation cancellations can be made in writing (via email or registered mail). Cancellations made by phone are not valid. Reservation cancellations are valid from the moment the written communication reaches Villas Planet Luxury.

Entry/Exit to Villas

The villa entry time on the reservation start date is generally 15:00. The check-out time for all our regions is generally by 10:00 in the morning at the latest. The entry and exit times are specified on the villa pages. It is important to plan your travel according to these times to prevent any inconvenience for both parties. In the case of an early exit request, Villas Planet Luxury must be informed 24 hours in advance. If the customer wishes to leave the villa early on their own accord, no refund will be provided.

Villa Capacity

Guests exceeding the stated capacity of the villa or the number of persons specified during booking will not be accepted. If the customer wishes to make a change in the number of people after the reservation is finalized, written application must be made to Villas Planet Luxury, and with the approval of Villas Planet Luxury according to the villa’s capacity, this change may be accepted. Villas Planet Luxury may request additional fees from the customer. Once entry to the villa is made, no additional guests beyond those listed in the reservation will be accepted. In cases where this rule is violated, Villas Planet Luxury reserves the right to request the guests to vacate the villa, cancel the reservation entirely, or demand the immediate evacuation of the villa before the end of the rental period.

Villa Cleaning/Maintenance and Additional Expenses

Entrance cleaning is included in the weekly villa rental prices. For 1-week stays, weekly cleaning and towel/sheets change are included in the prices. Any additional cleaning or towel/sheets change requested will be subject to an additional fee. In order to perform the periodic maintenance of all pool, garden, and other fixtures of the villas, the assigned personnel may need to enter the villa or its garden. For the continuity of these services, the customer must allow the personnel to enter the villa when necessary. Unless specified on the villa detail page of our website, electricity, water, gas cylinder, pool lighting, internet connection, and air conditioning usage are included in the prices. Pool lighting, air conditioning, and internet may not be standard in all our villas, so it is recommended to carefully read the features of the villa you rented on the villa details page.

Pets/Smoking

Unless otherwise specified, pets are not allowed in our villas. Smoking is not allowed in the indoor areas of our villas.

Damage Deposit

A different amount of damage deposit will be collected from customers according to the specifics of each villa. This deposit amount will be stated in writing in the confirmation document sent to the customer during the reservation process (the deposit amount is indicated on the villa features table or villa/detail page). The damage deposit will be collected in cash from the customer on the entry day to the villa, and if upon inspection before leaving the villa, there is no damage/deficiency, etc., in the villa and its fixtures, the deposit will be refunded in cash. If the customer wishes to leave the villa earlier than specified in the contract or if the exit check cannot be completed due to congestion, the deposit will be sent to a bank account provided by the customer. In the event of damage exceeding the deposit amount, the customer will be required to pay for the damage, otherwise legal actions will be taken.

Our Responsibilities and Guarantee

Villas Planet Luxury is responsible for delivering the villa as clean and ready for use to the customer at the specified date and time. Upon entry to the villa, if there are any defective or non-functioning items or issues, the customer must immediately inform Villas Planet Luxury and request the resolution of these issues. Villas Planet Luxury will notify the villa owner or the relevant company and ensure the resolution of these issues within 48 hours. Villas Planet Luxury is not responsible for the resolution of the issue but will assist in addressing it. Villas Planet Luxury cannot be held responsible for issues not reported on time. Villas Planet Luxury acts as an intermediary between the villa owner and the customer, and therefore the villa owner is responsible for resolving any issues in the villa. Additionally, Villas Planet Luxury cannot be held responsible for any accidents, illnesses, injuries, drownings, deaths, thefts, fires, thefts, or any other incidents and accidents that are the responsibility of the customer, thefts or accidents that occur during the customers stay, or any services obtained from third parties/companies for travel, shopping, food, beverages, entertainment, transportation, travel, guide services, etc. during their vacation.

Customers must sign the “Villa Rental Agreement” drafted by Villas Planet Luxury at the villa entry, otherwise, all payments made by the customer to Villas Planet Luxury will not be refunded and the villa accommodation will not be provided (the rental will be unilaterally terminated by Villas Planet Luxury).

Customers’ Responsibilities

Customers are responsible for using the villa, pool, garden furniture, all electrical and electronic appliances, and other furniture delivered to them in working and good condition in a clean manner. Customers must leave all kitchen utensils that were delivered clean in the same state. On the villa’s checkout day, all trash must be disposed of, and dishes washed before handing over the villa. Otherwise, in the case of leaving the villa unreasonably dirty or beyond reasonable standards of cleanliness, Villas Planet Luxury will deduct a cleaning fee from the damage deposit.

In the event of any damage occurring in the villa, customers are required to inform Villas Planet Luxury. Customers are responsible for paying for any damage and lost items during their stay. The cost of any damage and lost items will be deducted from the damage deposit if one was taken, or customers will be required to pay for it in cash if a damage deposit was not collected.

Moreover, customers and their companions must adhere to social and moral norms, avoid making noise that disturbs the environment, refrain from playing loud music, and refrain from engaging in behaviors prohibited by the laws of our country and recognized as crimes. In cases where a complaint is received by Villas Planet Luxury concerning the behavior of the customer and their companions, Villas Planet Luxury has the right to request the customer to vacate the villa before the reservation period ends.

Customers staying at villas described as conservative (villas with outside-invisible pools) on our website cannot be provided with a 100% guarantee of invisibility. In terms of invisibility, customers are responsible for ensuring their own privacy. Villas Planet Luxury does not accept any responsibility in such cases.

The tenant (customer) must read, understand, and sign the “VILLA RENTAL AGREEMENT” prepared by Villas Planet Luxury at the villa entry. Otherwise, all money previously paid to Villas Planet Luxury will not be refunded, and villa accommodation will not be provided (the rental will be unilaterally terminated by Villas Planet Luxury).

Force Majeure

In case of force majeure events, Villas Planet Luxury may unilaterally terminate this contract without assuming any legal liability. Events such as war, war threats, uprisings, strikes, natural disasters, fires, terrorist activities, epidemic diseases, technical problems in transportation, infrastructure and superstructure works done by municipalities or public institutions, prohibitions by state authorities in the region, and unforeseeable events occurring beyond our control will be considered as force majeure circumstances.

Complaints

Customers must report their complaints to Villas Planet Luxury immediately during their stay at the villa. The complainant situation will be examined by Villas Planet Luxury officials, and necessary measures will be taken promptly. Villas Planet Luxury cannot be held responsible for complaints made after the stay is completed and the villa is vacated.

Security and Privacy Policy

villasplanetluxury.com will not disclose personal information to any company or third parties except in cases defined in this Privacy Policy and Terms of Use Agreement. villasplanetluxury.com never sells the personal information of visitors, registered users, or partners to third parties.

Personal information includes any information that identifies the user, such as name, address, phone number, email address.

villasplanetluxury.com may use personal information to create user profiles and conduct statistical studies, and only share it with third parties for the purpose of conducting these studies.

villasplanetluxury.com is committed to keeping personal information private and confidential, considering it a matter of confidentiality and taking necessary precautions to protect and maintain confidentiality, prevent the entry of confidential information into the public domain or unauthorized use by third parties. villasplanetluxury.com will not be liable in case of damage to confidential information or its access by third parties resulting from attacks on the website and system.

Villas Planet Luxury may link to other sites on the www.villasplanetluxury.com site. villasplanetluxury.com is not responsible for the privacy practices and contents of sites accessed via links.

villasplanetluxury.com may detect and use user IP addresses as necessary and utilize this information. IP addresses can be used to identify users generally and collect comprehensive demographic information.

Disputes

Antalya Executive Offices and Courts are authorized in any disputes related to the matters covered by this contract.

CUSTOMERS WHO MAKE RESERVATIONS FOR ANY OF OUR VILLAS ARE DEEMED TO HAVE ACCEPTED ALL THE ABOVE TERMS. NONCOMPLIANCE WITH ANY OF THESE TERMS GIVES “Villas Planet Luxury” THE RIGHT TO UNILATERALLY CANCEL RESERVATIONS AND NOT PROVIDE A REFUND. English translation
